Terms and Conditions.

Last updated: May 2026. These terms apply to all HABITAT For Fitness memberships and services.
These Terms and Conditions, together with the Club Rules, form the full Membership Agreement between you and HABITAT For Fitness Limited. Please read them carefully before agreeing to a membership. If you have any questions, please ask us before signing up.

The agreement

These Terms, together with the Club Rules and your completed payment authority, make up all of the terms of a Membership Agreement between the member named in the account and HABITAT For Fitness Limited ("HABITAT", "we", "us").

By completing a Membership Application and agreeing to these Terms, you enter into a binding agreement with us. This agreement comes into force when you agree to these Terms, even if a HABITAT representative is not present at the time.

Your membership

Your membership type is agreed at the time of sign-up and determines the services you have access to, the number of class credits or visits per billing period (if applicable), your membership fees, and the minimum commitment period.

Your membership is personal to you and cannot be transferred to another person.

For credit-based memberships, credits are valid for 28 days from the date issued. Unused credits expire after 28 days. One credit allows for one class or gym entry. Additional top-up credits may be purchased through the HABITAT Members App or at reception.

When your membership starts

Your membership will start on the Membership Start Date set out in your Membership Application, provided that:

  • You have agreed to these Terms, your Membership Application, and your Payment Authority
  • You have completed a Health Check Questionnaire and, if applicable, provided any relevant medical information
  • We have received your upfront payment as set out in your Membership Application

Commitment periods and renewal

Your membership has a minimum initial commitment period of at least four weeks. After this initial period, your membership automatically renews for further two-week periods unless cancelled in accordance with section 8.

If your Membership Start Date falls mid-billing period, your initial commitment will include the remainder of that billing period plus the following four weeks.

Freezing your membership

You may freeze your membership by notifying us in writing or through the HABITAT Members App. The following conditions apply:

  • A freeze fee of $5 per week applies unless otherwise stated
  • Freezes must be for at least one full fortnightly billing period (minimum 2 weeks)
  • Notice must be received at least 4 days before the start of the billing period you wish to freeze
  • If you freeze during your Initial Commitment Period, the freeze period does not count toward your minimum term
  • You cannot use the online or app booking system while your membership is frozen, but you can contact us directly to make a booking
If you wish to visit while frozen, a casual visit fee will apply. Please contact us for current rates.

Cooling off period

You may cancel your membership within 7 days of signing up by completing a Cancellation Form at HABITAT or notifying us in writing. If you cancel within this period, we will refund your upfront payment and any membership fees paid.

If you have used your membership during the cooling off period, we will deduct the applicable casual visit fee for each visit and a reasonable administration charge from your refund.

Membership fees and payments

Membership fees are billed fortnightly via direct debit or credit card authority through our payment platform. You are personally responsible for ensuring payments are made on time.

Your membership fees are due for the whole of each commitment period, even if you do not use the facility.

We review membership fees periodically and may adjust them from time to time. We will give you at least 14 days notice of any fee change by email. If you do not accept the change, you may terminate your membership in accordance with section 8.

Other fees that may apply include freeze fees, late cancellation and no-show fees, failed payment fees, and personal training fees. Current rates are available at reception and in the HABITAT Members App.

The join fee stated in your Membership Application is non-refundable, except as outlined in section 6.

Cancelling your membership

You may cancel your membership at any time by notifying us in writing or through the HABITAT Members App. We require at least 14 days notice prior to the date you wish to stop your membership renewal.

We may terminate your membership immediately if:

  • You commit a serious or repeated breach of these Terms or the Club Rules
  • A breach is not remedied within 14 days of us giving notice
  • Any part of your membership fees remains unpaid 28 days after the due date
  • You provided false information when applying for membership

If we terminate your membership for any of these reasons, we may recover any outstanding fees and reasonable costs incurred as a result of your breach.

Class cancellation and no-show policy

If you have booked a class and cannot attend, you must cancel at least 1 hour before the class starts. Failure to cancel within this time will result in a no-show or late cancellation status being applied to your booking.

Credit-based memberships: your credit will be forfeited for no-shows and late cancellations.
Unlimited memberships: a $2 no-show or late cancel fee will be charged.

Changing your membership type

You may change your membership type at any time by notifying us in writing or through the HABITAT Members App. We require notice at least 4 days before the start of the billing period from which you want the change to take effect.

Student membership rates are only available to full-time students. If your student status changes, you must notify us immediately.

Club rules

By becoming a member you agree to comply with the HABITAT Club Rules. These are binding rules that apply to all members, guests, and visitors. You are also responsible for the conduct of any guests while they are using the facility.

The Club Rules are available at reception and on our website at habitatforfitness.co.nz/club-rules.

Changes to these terms

We reserve the right to make reasonable amendments to these Terms or the Club Rules at any time. We will give you at least 14 days notice by email before any changes take effect.

If any amendment materially reduces the benefits of your membership, you have the right to terminate your membership in accordance with section 8.

Health, risk, and safety

Exercising and using gym facilities involves a risk of injury. You exercise and use HABITAT facilities at your own risk. Please monitor your physical condition at all times and exercise at a level appropriate to your health and fitness.

If any unusual symptoms occur, stop immediately and notify a staff member.

We require you to complete a Health Check Questionnaire before commencing your membership. It is your responsibility to ensure the information you provide is accurate and to notify us of any changes to your health that may affect your ability to exercise safely.

Liability

In the course of exercising or engaging in recreational activities at HABITAT, if you are killed or injured, we will not be liable except to the extent caused by our gross negligence. Gross negligence means an act or omission done with reckless disregard for the consequences.

If you are under 18, a parent or guardian must sign on your behalf and will be responsible for your obligations under this agreement. By agreeing to these Terms you confirm that you are 18 or older, or that a parent or guardian has agreed on your behalf.

Your personal information

We take the privacy of our members seriously. Our Privacy Policy, available at
